Terms of Service
The short version
- DVC Compass is a free, independent tool for evaluating DVC confirmed-reservation rentals. It is not a broker, holds no money, and touches no booking.
- Listing data is collected from third-party broker sites and can be stale, incomplete, or wrong. Verify every detail with the broker before you pay anyone.
- You must be 18 or older to hold an account, and you are responsible for what happens under it.
- The service is provided as-is, and our liability is capped — we are not a party to your rental.
- Nothing is paid today. We may add paid features later; nothing will start charging you silently.
- DVC Compass is unofficial and unaffiliated — with Disney, and with the brokers whose listings we track. Nobody sends us a feed, and nobody has approved our numbers.
1. Who we are, and what these terms cover
DVC Compass (dvc-compass.com) is a project of Blue Holler Studios, LLC, a North Carolina limited liability company — "we" and "us" means Blue Holler Studios, LLC. These terms are the agreement between you and it, covering your use of the site and your account. By creating an account, you accept them. If you do not accept them, do not use the service.
2. What DVC Compass is — and is not
DVC Compass is an informational and analytical tool. Given a confirmed-reservation rental listing — resort, room type, view, dates, asking price — it computes the effective dollars-per-point and rates the deal: whether you are beating the cash price for the same room, and whether the premium over raw points is reasonable.
That is all it does. DVC Compass is not a broker, not a travel agency, and not a financial advisor. It does not facilitate, broker, or take part in any rental transaction. It holds no money, processes no payments, and touches no booking. Every rental happens between you, a broker, and a points owner — entirely on the broker's platform, under the broker's terms, with none of it passing through us.
Ratings and dollar-per-point figures are arithmetic over collected data, published as information. They are not financial, legal, or travel advice, and they are not a recommendation to transact with any particular broker or owner.
3. Not affiliated with Disney
DVC Compass is an independent, unofficial tool. It is not affiliated with, endorsed by, or sponsored by The Walt Disney Company, Disney Vacation Club, or any of their subsidiaries or affiliates. "Disney Vacation Club," "DVC," and related names are trademarks of their respective owners. Listings are sourced from third-party rental marketplaces; DVC Compass is not a broker and does not facilitate rentals. 4. Not affiliated with the rental brokers either
Section 3 says we are nothing to do with Disney. This one says the same about the brokers. DVC Compass is not affiliated with, endorsed by, sponsored by, or authorized by any of the rental marketplaces whose listings we track. We have no partnership, agreement, or arrangement with any of them. Their names and marks appear here only to identify where a listing came from — nothing more is implied by their presence.
We gather listings independently. No broker supplies us a feed. No broker has reviewed or approved what you see here — not the numbers, not the ratings, not a word of it — and none of them stands behind any of it. We are an outside observer, not a partner. If you want a broker's own price, terms, or availability, get them from the broker.
5. The data can be wrong — verify before you pay
Listings are collected automatically from third-party rental broker marketplaces. Nothing arrives on a feed — we go and look — so what you see is only ever as current as our last sweep. Collection has other limits besides: data can be stale, incomplete, or simply wrong. A listing we show as available may already be booked. Prices change on the broker's site before they change on ours. The broker is the source of truth; we are a lens on it, and lenses distort.
You are considering spending thousands of dollars on someone else's vacation reservation. So, plainly: confirm every detail — price, dates, resort, room, view, and the cancellation terms — with the broker before you pay anyone. Do not rely on our numbers, or our rating, alone. This is the single most important sentence in these terms.
You accept the risks of renting a confirmed reservation. Those risks are real and they are not ours: a listing may already be booked; a broker or owner may misrepresent a reservation, cancel it, or fail to deliver it; a reservation may be cancelled by the resort; and a rental is typically non-refundable. By using DVC Compass to evaluate a rental, you acknowledge that you are choosing to take those risks with your own money, in a transaction we are not part of, and that our rating is information rather than a promise about how it will turn out.
6. Eligibility and your account
- You must be at least 18 years old and the age of majority where you live. The service is about spending real money on rentals, and it is aimed at users in the United States.
- Give us a working email address and verify it. Email is how you reset your password and how we reach you about your account or these terms.
- Keep your password to yourself. You are responsible for activity under your account. If you believe someone else has accessed it, tell us at hello@dvc-compass.com.
- When you create an account, we record that you accepted these terms — when, and which version.
7. Acceptable use
Use the service to evaluate rentals. Beyond that, a short list of things not to do:
- Do not attempt to break into, probe, or disrupt the service, or interfere with anyone else's use of it.
- Do not send automated traffic at rates that degrade the service. If you want programmatic access, ask us first.
- Do not use another person's account, or share yours.
- Do not misrepresent our output as official Disney information, or as a broker's own listing data.
- Do not use the service to violate any law or a broker's terms.
We may rate-limit, suspend, or terminate accounts to protect the service.
8. Free today; paid features may come later
The service is free. There are no payments, subscriptions, or billing of any kind today. We reserve the right to introduce paid features in the future. If that happens, anything paid will be clearly labeled as paid before you commit to it — no existing free feature will silently start charging you.
9. Email and notifications
We send transactional email only: address verification, password resets, and — where we need to — notices about your account or these terms. We do not send marketing email. Push notifications are a separate, opt-in feature; alerting is currently limited while the product matures, and not every account has it. Where you have it, you can turn it off at any time.
10. Our content and yours
The service's software, design, and branding are ours. Listing data originates with the brokers and owners who publish it; our contribution is the collection, normalization, and analysis layered on top. You may use the service and its output for evaluating rentals; do not republish our data in bulk as a competing product. The names and criteria you save with your searches remain yours.
11. No warranty
The service is provided "as is" and "as available," without warranties of any kind, express or implied — including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty as to the accuracy, completeness, or timeliness of listing data, points math, cash-rate comparisons, or ratings.
In plain terms: we cannot promise the data is right, current, or complete, and we cannot promise the site will always be up. It is a free tool built on data published by others. Do not spend thousands of dollars on our say-so alone — check with the broker.
12. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost savings, or money lost in a rental transaction, arising out of or relating to the service or these terms — even if we have been advised such losses were possible. Our total liability to you for all claims combined will not exceed one hundred US dollars (USD 100).
The reasoning, plainly: DVC Compass is a free tool that summarizes information published elsewhere. We are not a party to your rental. If a deal goes wrong, the money moved between you, a broker, and an owner — none of it through us — and the cap reflects that.
Some jurisdictions do not allow certain warranty exclusions or damage limitations. Where such a rule applies to you, sections 11 and 12 apply to the fullest extent the law allows.
13. Indemnification
If your violation of these terms, or your misuse of the service, causes a third party to bring a claim against us, you agree to cover the resulting losses and reasonable legal costs. This clause is triggered only by a breach of the rules above; ordinary use of the service does not engage it.
14. Termination
You can leave whenever you like, and you do not have to ask us: delete your account from your account page and it goes, along with everything attached to it, as described in the Privacy Policy. We may suspend or terminate accounts that violate these terms, or as needed to protect the service. If we ever discontinue the service, we will give account holders reasonable notice by email when feasible. Sections 3 through 5, and 10 through 16, survive termination.
15. Governing law and disputes
These terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Buncombe County, North Carolina, and you consent to their jurisdiction.
Before either of us files anything: email hello@dvc-compass.com describing the problem, and give us 30 days to try to fix it. Most disputes are misunderstandings, and this one costs nothing.
Two exceptions, so that this clause cannot be used as a weapon. It does not apply where a party seeks emergency injunctive or other equitable relief, which by its nature cannot wait 30 days. And it does not shorten any deadline for bringing a claim: if a limitations period would run out during those 30 days, it pauses for the length of them. Waiting to talk should never cost you the right to sue.
16. Changes, and the small print
- Changes. We may update these terms. For material changes we will email account holders before the new version takes effect. Continued use after the effective date is acceptance; if you do not agree, stop using the service and delete your account.
- Severability. If a court finds part of these terms unenforceable, the rest stands.
- No waiver. Not enforcing a provision once does not waive it.
- Entire agreement. These terms are the whole agreement between you and us about the service. The Privacy Policy describes what we do with your data and is incorporated here only for that purpose — it is a statement of our practices, not a set of contractual warranties.
